Whistleblower / Qui Tam Litigation

The Whistleblower / Qui Tam Group at Berger & Montague, P.C. has extensive experience representing whistleblowers in recovering money from companies who have defrauded the government. We have recovered more than $1.1 billion for federal and state governments, including tens of millions of dollars for our whistleblower clients.

The qui tam provisions of the federal and many state False Claims Acts allow a private citizen with knowledge of fraud to bring a case on behalf of the federal and/or state governments against companies cheating those governments. The federal and state False Claims Acts encourage private individuals to help the government fight fraud and recover taxpayers’ money.

While many of the Whistleblower / Qui Tam Group’s cases are against large pharmaceutical companies for Medicare and Medicaid fraud, potential cases can involve fraud in any other industry where government money is at stake. For instance, the government has designated over $1 trillion in Stimulus and TARP funds in direct response to the severe economic crisis.  Recipients of Stimulus or TARP funds may be subject to the False Claims Act.  Under the applicable laws and depending on the development of the case, the whistleblower or “relator” may receive a share of up to 30% of any eventual recovery.

If you are aware of a fraud being committed against the government and wish to learn more about becoming a potential whistleblower plaintiff, please contact Gary Azorsky at 215-875-3090 (gazorsky@bm.net).

The Whistleblower / Qui Tam Group has the specialized skill, knowledge and experience in representing whistleblowers to successfully litigate a qui tam action. This unique expertise includes:

  • close working relationships with attorneys at the United States Department of Justice and numerous Attorney General’s Offices including those offices for the states of California, Florida and Texas in litigating qui tam cases;
  • firm resources and available attorneys to support successful litigation of qui tam cases which are often large, complex and sometimes protracted;
  • specialized understanding of the federal and state False Claims Act’s unique provisions as well as other related areas of law; and
  • extensive experience in cultivating close, productive attorney-client relationships with whistleblower clients, which contributes to achieving successful results.
