Hickman, et al. v. Amazon, TL Transportation, et al.
On September 17, 2019, Berger Montague PC and Willig, Williams & Davidson filed a Third Amended Class and Collective Action Complaint in the United States District Court for the Eastern District of Pennsylvania, alleging violations of the Fair Labor Standards Act (“FLSA”) and Pennsylvania, Maryland, and New Jersey state laws on behalf of Plaintiffs Tyhee Hickman, Shanay Bolden, and O’Donald Henry, individually and on behalf of all persons similarly situated, against Defendants TL Transportation, LLC, Scott Foreman, Herschel Lowe, Amazon.com, LLC, and Amazon Logistics, Inc.
The lawsuit concerned the TL Transportation’s alleged unlawful policy and practice of failing to pay overtime compensation to Delivery Associates who, until April 15, 2017, were paid pursuant to a day rate compensation system in violation of the FLSA, Pennsylvania, Maryland and New Jersey state laws, and whether Amazon should bear legal responsibility for these violations as a joint employer. On August 16, 2018, the District Court ruled that the pay scheme at issue constituted a violation of the FLSA and related state laws.
We have reached a $1,800,000.00 settlement in this matter on behalf of Delivery Associates who were employed by Defendant TL Transportation LLC to deliver packages to Amazon customers in the United States at any time between March 8, 2014, and April 15, 2017.
On September 19, 2019, we filed Plaintiffs’ Unopposed Motion for Preliminary Approval of the Settlement Agreement. The Court granted Preliminary Approval on October 23, 2019.
