Marrero v. Fifth Third Bank Lawsuit
On November 2, 2011, Berger & Montague filed a class action complaint in Illinois state court alleging that Fifth Third Bancorp failed to compensate its loan officers for their overtime. The complaint alleges violations of the Illinois Minimum Wage Law (“IMWL”) and the Illinois Wage Payment and Collection Act (“IWPCA”), along with common law causes of action.
About the case
In January 2011, Fifth Third reclassified its loan officers in recognition of the fact that they were not properly classified as exempt from state and federal overtime requirements. Even after this reclassification, Fifth Third’s supervisors instructed loan officers not to report overtime hours on their timesheets in an effort to evade these wage and hour laws.
