Bergonzi v. Central States Health and Life Company of Omaha

Berger Montague served as lead counsel in this national insurance-related class action on behalf of cancer patients against Central States Health and Life Company of Omaha (“Central States”) and obtained a $20 million settlement. Berger Montague litigated this case in the United States District Court for the District of South Dakota. The plaintiffs alleged that Central States breached the terms of its insurance policies when it underpaid or refused to pay for health insurance benefits for chemotherapy and radiation treatment, and that the denials and underpayments were in bad faith.

For his efforts in this successful case, Berger Montague shareholder Peter R. Kahana became the recipient of the American Association for Justice’s Steven J. Sharp Public Service Award, which is presented annually to those attorneys whose cases tell the story of American civil justice and help educate state and national policymakers and the public about the importance of consumers’ rights.
