In re Lipitor Antitrust Litigation

Berger Montague currently serves as Co-Lead Counsel on behalf of a class of direct purchasers of brand or generic versions of the prescription drug Lipitor from Pfizer (Pfizer Manufacturing Ireland, Warner-Lambert Co., and Warner-Lambert Co. LLC) or Ranbaxy (Ranbaxy Inc., Ranbaxy Laboratories Limited, and Ranbaxy Pharmaceuticals, Inc.) (Pfizer and Ranbaxy are collectively referred to as “Defendants”) in this antitrust class action involving alleged efforts to delay generic competition of Lipitor (generic name: atorvastatin calcium).  

The case is currently pending in the United States District Court for the District of New Jersey and is captioned In re Lipitor Antitrust Litigation, No. 12-cv-02389 (D.N.J.).

On March 8, 2024, U.S. District Court Judge Peter G. Sheridan of the District of New Jersey granted preliminary approval of a $93 million settlement between Pfizer and the settlement class of direct purchasers of brand or generic Lipitor as set forth in the Order Granting Direct Purchaser Class Plaintiffs’ Unopposed Motion for Certification of a Settlement Class, Appointment of Lead Class Counsel, Preliminary Approval of the Proposed Settlement, Approval of the Form and Manner of Notice to the Class and Proposed Schedule for a Fairness Hearing.
