Berger Montague is Counsel for Plaintiffs-Appellants appealing the grant of a motion to dismiss in the Delaware Supreme Court. Berger Montague brought class action lawsuit against AMC on behalf of a class of preferred shareholders. The preferred shareholders allege that AMC violated the anti-dilution provision they were contractually entitled to. Plaintiffs are appealing to the Delaware Supreme Court after the Court of Chancery granted AMC’s motion to dismiss. The Court granted oral argument and Associate Matt Summers will be arguing the case on April 30, 2025.
