Biography
Kyla Gibboney is an Associate in Berger Montague’s Antitrust and Appeals & Complex Briefing Departments, where she specializes in antitrust class actions and appellate litigation. She is based in San Francisco.
Ms. Gibboney represents consumers, businesses, and employees harmed by corporate misconduct across industries. She currently leads high-stakes litigation against the world’s largest retailer and has played a critical role in the firm’s cases against the Ultimate Fighting Championship (“UFC”), pharmacy benefit managers, and elite universities. Ms. Gibboney was part of the team that successfully tried Innovative Health, LLC v. Biosense Webster, Inc. to a $442 million jury verdict in the Central District of California after Berger Montague won a Ninth Circuit reversal of a district court’s summary judgment order in the defendant’s favor. Ms. Gibboney was among the Berger Montague team honored by the American Antitrust Institute (“AAI”) with the Outstanding Antitrust Litigation Achievement in Private Law Practice award for that case.
Ms. Gibboney has taken on a significant appellate role at Berger Montague. She recently argued in the Federal Circuit in Harrow v. Department of Defense, a case Berger Montague successfully appealed to the Supreme Court, obtaining a 9-0 decision in Petitioner Stuart Harrow’s favor.
Before joining Berger Montague, Ms. Gibboney prosecuted antitrust, consumer protection, and securities class actions at a nationally recognized complex litigation firm in the Bay Area. During her time there, she successfully tried two class cases against water districts in Southern California for violating the California Constitution. The Daily Journal awarded Ms. Gibboney and the trial team the California Lawyer Attorney of the Year (CLAY) award for their achievement.
Ms. Gibboney is an active member of the California antitrust bar. She currently serves on the Executive Committee of the California Lawyers Association’s Antitrust and Consumer Protection Section, where she organizes conferences and other events for practitioners and law students, and speaks on issues related to complex litigation procedure, antitrust, and legal ethics. Ms. Gibboney received her J.D., cum laude, from the University of California College of the Law, San Francisco. She received her undergraduate degree from the University of California, Berkeley. During law school, she served as an extern with the Antitrust Division of the U.S. Department of Justice and completed two judicial externships. She was also a board member and competitor on the moot court team and was recognized for her commitment to pro bono work.
