Containerboard Antitrust Lawsuit
Berger Montague serves as one of the counsel on behalf of direct purchasers of containerboard products (which includes both linerboard, corrugated sheets and corrugated products such as boxes and other containers) in an antitrust class action against the largest domestic manufacturers of containerboard.
About the case
Plaintiffs allege that from at least February, 2004 to November, 2010 the defendants conspired to inflate prices for containerboard products in the United States. In March, 2015, a Class was certified on behalf of direct purchasers from the Defendants PCA, Noramac, International Paper, Temple-Inland, and Weyerhaeuser, Georgia-Pacific and West Rock.
This case is pending in the Northern District of Illinois before the Hon. Harry D. Leinenweber. After extensive discovery, settlements were reached and approved with all but two of the Defendants, Georgia-Pacific, LLC and West Rock CP, LLC (formerly Smurfit-Stone Container). In an Opinion on August 3, 2017, the Court granted summary judgment to those two Defendants and the Opinion is currently on appeal to the Seventh Circuit of Appeals.
