Berger Montague served as co-lead counsel and obtained a $750 million settlement on behalf of a class of direct purchasers of branded and/or generic Namenda IR and/or branded Namenda XR, from Forest or its successors in interest, Actavis and Allergan, and/or from any generic manufacturer at any time during the period from June 2012 to September 2015. Led by David F. Sorensen of Berger Montague, the case was litigated in the United States District Court for the Southern District of New York and captioned In re Namenda Direct Purchaser Antitrust Litigation, No. 15-cv-7488 (S.D.N.Y.). This is the largest single-defendant settlement in U.S. history for a case alleging delayed generic competition.
