Berger Montague is pursuing justice for parents of premature infants against Abbott Laboratories and Mead Johnson for injuries caused by their cow’s milk-based infant formulas, Similac and Enfamil. Consumption of cow’s milk-based infant formula has been linked to necrotizing enterocolitis (NEC) in both premature and low-birth-weight infants, resulting in life threatening illness and potentially death.
The number of lawsuits filed against Abbott Laboratories and Mead Johnson for the injuries caused by their cow’s milk-based formula has grown to over 1,000 file lawsuits. The majority of these lawsuits are consolidated in the Preterm Infant Formula NEC Multidistrict Litigation in the Northern District of Illinois (Abbott Laboratories Preterm Infant Nutrition Prod. Liab. Lit – MDL No. 3026) overseen by the Honorable Judge Rebecca Pallmeyer. There are also cases pending in several state court venues, including courts in Illinois and Pennsylvania. Berger Montague associate Najah Jacobs was chosen to by the Plaintiffs’ Leadership Committee to serve on the discovery committee in the Preterm Infant Formula NEC Multidistrict Litigation.
To date, there has been one jury verdict against Mead Johnson in St. Clair County, Illinois. In that case, the jury awarded $60 million to a St. Clair, Illinois mother who alleged that Mead Johnson’s Enfamil formula caused her son to die from NEC. There has also been one jury verdict against Abbott Laboratories. In that case, a Missouri jury awarded $495 million to the family of a baby facing permanent health complications due to NEC caused by Abbott’s Similac formula.
