Quest Diagnostics Data Breach Class Action Lawsuit

About the Data Breach
The case is brought on behalf of 11.9 million Quest patients whose sensitive personal information was stolen by computer hackers in a cyber-attack.
The cyber-attack took place at Quest’s collections vendor, American Medical Collection Agency (AMCA). The breach involves Quest patients whose past-due bills were sent to AMCA for collections.
Information compromised in the data breach includes Social Security numbers, financial information (e.g., credit card numbers and bank account information), medical information, and additional personal information.
Risks to Class Members
Armed with the stolen information, data thieves can commit a variety of crimes, including:
- Opening new financial accounts in class members’ names;
- Taking out loans in class members’ names;
- Using class members’ names to obtain medical services;
- Using class members’ information to obtain government benefits;
- Filing fraudulent tax returns using class members’ information;
- Obtaining driver’s licenses in class members’ names but with another person’s photograph;
- Giving false information to police during an arrest; and
- Committing credit card or bank account fraud.
Due to the data breach, class members have been exposed to a heightened risk of fraud and identity theft and must now closely monitor their financial accounts to guard against fraud. Class members might also incur out-of-pocket costs for purchasing credit monitoring services, credit freezes, credit reports, or other protective measures to deter and defect identity theft.
What the Class Action Seeks
The class action seeks: (i) compensation for out-of-pocket losses and time spent responding to the breach; (ii) credit monitoring and identity theft insurance for several years; and (iii) substantial improvements to Quest’s data security procedures.
