Biography
E. Michelle Drake is an Executive Shareholder. She founded and manages Berger Montague’s second-largest office, located in Minneapolis. With career settlements and verdicts valued in the billions, Ms. Drake has had great success in a wide variety of cases. She chairs the firm’s Credit Reporting and Background Checks Practice Group and co-chairs the firm’s Consumer Protection Group and its Technology, Privacy and Data Breach Practice Group.
Ms. Drake has practiced law for more than twenty years and holds degrees from Harvard College, Harvard Law School, and Oxford University. Possessing a rare combination of an elite academic pedigree and real-world trial skills, Ms. Drake has successfully gone toe-to-toe with some of the world’s most powerful companies. She began the practice of law by defending high-stakes criminal cases as a public defender in Atlanta, Georgia, and has also represented people facing the death penalty, including at trial. Ms. Drake has never lost her desire to litigate on the side of the “little guy.” She is empathetic towards her clients and unyielding in her desire to win.
Ms. Drake has extensive experience representing consumers in MDL proceedings and class actions. In total, Ms. Drake has served as lead or co-lead class counsel in over fifty class actions and has achieved relief for consumers valued in the billions of dollars. She is currently leading numerous consumer protection class actions around the country—including representing hundreds of thousands of doctors and medical providers whose medical practices were decimated when United Health Group shut down Change Healthcare in the wake of the largest healthcare data breach in history. Ms. Drake also serves as lead class counsel for hundreds of thousands of individuals falsely labeled as deceased by TransUnion, an all too common problem with credit reporting. She has also represented hundreds of thousands of individuals falsely labeled as terrorists, narcotics traffickers, and criminals. She led landmark litigation against all three of the major credit bureaus, resulting in industry-wide reform in the reporting of public records, and practice changes that provided billions of dollars in benefits to impacted consumers.
Through her dogged representation of her clients and her dedication to achieving great results, Ms. Drake has earned the respect of her peers. She is consistently named to the annual lists of The Best Lawyers of America, Top 50 Women Minnesota Super Lawyers, and Super Lawyers. Ms. Drake is routinely invited to present at continuing legal education seminars, and has presented at dozens of national conferences. She has been quoted in the New York Times, the Wall Street Journal, and the National Law Journal, and her cases have been named as “Lawsuits of the Year” by Minnesota Law & Politics. Ms. Drake is also dedicated to public service. She currently serves as the Chair of the Board of Directors of the Southern Center for Human Rights.

Prominent Judgments & Settlements
- Arnett v. Bank of America, N.A., No. 3:11-cv-1372 (D. Or.). Co-Lead Counsel. Ms. Drake obtained a settlement of $31 million on behalf of a nationwide class of borrowers whose mortgage loans were serviced by Bank of America and who were force-placed with flood insurance by Bank of America.
- Bible v. United Student Aid Funds, Inc., No. 1:13-cv-00575 (S.D. Ind.). Serving as co-lead counsel, Ms. Drake obtained a $23 million settlement on behalf of a nationwide class of borrowers against United Student Aid Funds, Inc. for alleged breach of contract and violations of the Racketeer Influenced and Corrupt Organizations Act (“RICO”).
- Bingollu v. One Source Technology, LLC d/b/a Asurint, No. 0:22-cv-00077-DTS (D. Minn.). Ms. Drake was one of class counsel in class action involving allegations that consumer reporting agency inaccurately reported consumers’ Social Security Numbers as being “not verified” or “unable to validate,” achieving a $2.4 million common fund settlement for the class.
- Citibank Force-Placed Insurance Litigation, Nos. 5:12-cv-00820, 1:13-cv-353 (N.D.N.Y.) Ms. Drake obtained a settlement valued at $110 million in this consolidated class action on behalf of nationwide classes of borrowers whose mortgage loans were serviced by Citibank or CitiMortgage and who were force-placed with hazard, flood or wind insurance by Citi.
- Clark v. Experian Info. Sols., Inc., No. 16-cv-32 (E.D. Va.). FCRA class action, alleging violations by credit bureau, providing a nationwide resolution of class action claims asserted by 32 plaintiffs in 16 jurisdictions, including injunctive relief and an uncapped mediation program, for millions of consumers.
- Clark/Anderson v. Trans Union, LLC, No. 15-cv-391 & No. 16-cv-558 (E.D. Va.). FCRA consolidated class action, alleging violations by credit bureau, providing groundbreaking injunctive relief, and an opportunity to recover monetary relief, for millions of consumers.
- Ernst v. DISH Network, LLC, DISH Network Service, LLC, and Sterling Infosystems, Inc., No. 12-cv-8794-LGS (S.D.N.Y.) Lead Counsel. Ms. Drake obtained a $4.75 million settlement with Sterling on Fair Credit Reporting Act claims against background check company Sterling for improperly reporting outdated criminal background information. Ms. Drake defeated DISH’s motion for summary judgment litigation against DISH is ongoing.
- Farmer v. Bank of America, No. 5:11-cv-00935-OLG (W.D. Tex.) Lead Counsel. Ms. Drake obtained a $10 million settlement on behalf of Texas borrowers who were force-placed or otherwise improperly required to obtain insurance on their homes.
- Fernandez v. CoreLogic Credco, LLC, No. 20-cv-1262 (S.D. Cal.). Ms. Drake was class counsel in this class action alleging violations by consumer reporting agency related to reporting possible matches to the OFAC List, resulting in historic $58.5 million gross settlement, the second-largest class action FCRA settlement.
- Gambles v. Sterling Infosystems, Inc., No. 15-cv-9746 (S.D.N.Y.). FCRA class action, alleging violations by consumer reporting agency, resulting in a gross settlement of $15 million, one of the largest FCRA settlements to date.
- Grissom v. Sterling Infosystems, Inc., No. 1:20-cv-07948-VSB (S.D.N.Y.) Ms. Drake was class counsel in action involving allegations that consumer reporting agency included records developed through a SSN trace on consumers’ reports that did not match that consumers’ full name, achieving settlement that provides $2.5 million common fund for the class.
- Halvorson, et al. v. TalentBin, Inc., No. 3:15-cv-05166 (N.D. Cal.). Serving as lead counsel, Ms. Drake obtained a $1.5 million settlement on behalf of a nationwide class against a large consumer reporting agency for alleged violations of the Fair Credit Reporting Act.
- Hart v. RCI Hospitality Holdings, Inc., No. 09 Civ. 3043, 2015 WL 5577713 (S.D.N.Y.) Lead Counsel. Ms. Drake achieved final approval of a settlement valued at $15 million on behalf of a certified class of 2,000 female adult entertainers who were improperly misclassified as independent contractors, denied the minimum wage, and required to pay a variety of unlawful fees and fines.
- Heaton v. Social Finance, Inc., No. 14-cv-05191- TEH (N.D. Cal.) As co-lead class counsel in case involving impermissible access to consumer credit files, Ms. Drake was instrumental in achieving injunctive relief to change the hard inquiries to soft credit inquiries on class members’ credit, and a $2,500,000 common fund.
- Hill-Green v. Experian Info. Sols., Inc., No. 3:19-cv-00708-MHL (E.D. Va.). Ms. Drake was co-lead class counsel in credit reporting case involving allegations related to credit bureau’s data analysis relating to fraud alert reporting, achieving injunctive relief settlement as well as monetary relief settlement of $23 million.
- Hillson v. Kelly Services, Inc., No. 2:15-cv-10803 (E.D. Mich.). Serving as co-lead counsel, Ms. Drake obtained a $6.7 million settlement on behalf of a nationwide class of employees and applicants against a national staffing company.
- Hofstetter v. Chase, No. 10-cv-1313-WHA (N.D. Cal.) Lead Counsel. Ms. Drake obtained a $10 million settlement on behalf of a nationwide class of borrowers who were improperly force-placed with flood insurance.
- Howell v. Checkr, Inc., No. 17-cv-4305 (N.D. Cal.). Ms. Drake led FCRA class action, alleging violations by consumer reporting agency, resulting in a $4.46 million settlement.
- In re Target Corp. Customer Data Security Breach Litig., MDL No. 14-2522 (D. Minn.). Ms. Drake was appointed liaison counsel on consumer track in data security breach class action, resulting in a $10 million settlement for consumers.
- In re TransUnion Rental Screening Solutions, Inc. FCRA Litigation, No. 1:20-md- 02933 (N.D. Ga.) Ms. Drake was co-lead counsel in consolidated MDL, achieving over $11 million in monetary relief, as well as injunctive relief, on behalf of hundreds of thousands of individual consumers.
- In re: Juul Labs, Inc., Marketing, Sales Practices, and Products Liability Litigation, No. 3:19-md-02913-WHO (N.D. Cal.) Ms. Drake was appointed to the Plaintiffs’ Steering Committee and chaired the consumer class action committee, achieving an overall MDL settlement of approximately $1.2 billion, and a consumer class settlement of $255 million)
- In re: MGM Resorts International Data Breach Litigation, No.: 2:20-cv-00376 (D. Nev.) Ms. Drake was appointed co-lead counsel in this data breach class action affecting tens of millions of consumers, and which recently achieved preliminary approval of a $45 million settlement.
- Knights v. Publix Super Markets, Inc., No. 3:14-cv-00720 (M.D. Tenn.) Lead Counsel. Ms. Drake obtained a $6.8 million settlement in this Fair Credit Reporting Act case challenging Publix’s improper procedures for obtaining background checks on its employees.
- Legrand v. IntelliCorp Records, Inc., No. 15-cv-2091 (N.D. Ohio). Ms. Drake led this FCRA class action, alleging violations by consumer reporting agency, resulting in a $1.1 million settlement.
- Rasschaert v. Frontier, No. 11-cv-02963-DWF (D. Minn.) Lead Counsel. Ms. Drake secured a settlement whereby Frontier applied for a $9 million sales tax refund on behalf of a class of Minnesota internet customers from whom Frontier improperly collected sales tax.
- Rilley v. MoneyMutual, LLC, No. 16-cv-4001 (D. Minn.). Court certified a litigation class of over 20,000 Minnesota consumers alleging that MoneyMutual violated Minnesota payday lending regulations, resulting in $2 million with notable injunctive relief.
- Rodriguez v. National Credit Center, LLC, No. A-23-869000-B (Clark Cnty.) Ms. Drake led this FCRA class action, alleging violations by consumer reporting agency related to reporting of inaccurate matches to the OFAC List, resulting in class action settlement of $30 million gross settlement for consumers.
- Rubio-Delgado & Moore v. Aerotek, Inc., Nos. 2:15-cv-2701, 2:16-cv-1066 (S.D. Ohio). Serving as lead counsel, Ms. Drake obtained a $15 million settlement on behalf of a nationwide class of employees and applicants against a large temporary staffing company for alleged violations of the Fair Credit Reporting Act.
- Saylor v. RealPage, Inc., No. 1:22-cv-00053-AJT-IDD (E.D. Va.) As class counsel in credit reporting case regarding inaccurate reporting of consumers as sex offenders, Ms. Drake achieved settlement for $9.7 million.
- Singleton v. Domino’s Pizza, No. 8:11-cv-01823(DKC (D. Md.) Lead Counsel. Ms. Drake obtained a $2.5 million settlement on behalf of a nationwide class in this Fair Credit Reporting Act case which challenged Domino’s improper procedures for obtaining and using employment-related background checks. Ms. Drake successfully defeated a motion to dismiss in this case, establishing authoritative precedent on the impropriety of including liability releases in required disclosures.
- Steinberg v. CoreLogic Credco, LLC, No. 3:22-cv-00498-H-SBC (S.D. Cal.). Ms. Drake was class counsel in this class action involving allegations that credit reporting agency inaccurately reported living consumers as deceased, achieving a $5.695 million common fund settlement for class members, as well as injunctive relief.
- Stewart v. LexisNexis Risk Data Retrieval Services, LLC, No. 3:20-cv-00903-JGA (E.D. Va.) As co-lead counsel on credit-reporting case involving inaccurate reporting of tax liens and judgments, helped achieve settlement resulting in injunctive relief and monetary relief of $24 million for the classes.
- Taylor v. Inflection Risk Solutions, LLC, No. 20-cv-2266 (D. Minn.) Ms. Drake was co-lead class counsel in action involving claims that consumer reporting agency mischaracterized criminal convictions and certain offenses in its reports on consumers, achieving $4 million common fund settlement.
- Thomas v. Equifax Info. Services, LLC, No. 18-cv-684 (E.D. Va.). Ms. Drake was part of class counsel in this FCRA class action, alleging violations by credit bureau, providing nationwide resolution of class action claims asserted across multiple jurisdictions, including injunctive relief, and an uncapped mediation program for millions of consumers.
- Walker v. Inflection Risk Solutions, LLC, No. 22-CIV-02954 (San Mateo Super. Ct.) Ms. Drake was class counsel in action involving claims that consumer reporting agency inaccurately reported consumers as sex offender or with inaccurate criminal histories on its reports, achieving finally approved settlement that provides $1.765 million common fund settlement.
