Berger Montague represented a proposed class of direct purchasers of titanium dioxide, a product used in paints, inks and other applications.

Plaintiffs alleged that defendants (Huntsman, Kronos Worldwide, Inc., DuPont and Millennium Inorganic Chemicals, Inc.), the primary suppliers of titanium dioxide in the U.S., conspired to raise, maintain or stabilize the prices for the product between March, 2002 and the present.

In 2011, Judge Bennett denied defendants’ motions to dismiss. In 2012, Judge Bennett certified a class of titanium dioxide direct purchasers. In 2013, Judge Bennett denied defendants’ motions for summary judgment.

Plaintiffs and defendants reached settlements totaling $163.5 million during the second half of 2013. In December 2013, Judge Bennett granted final approval to the settlements and settlement funds were distributed in the months thereafter.
