Berger Montague served as class counsel and obtained settlements totaling $163.5 million on behalf of direct purchasers of titanium dioxide, a product used in paints, inks and other applications. The plaintiffs alleged that the defendants, including Huntsman, Kronos Worldwide, Inc., DuPont, and Millennium Inorganic Chemicals, Inc., the primary suppliers of titanium dioxide in the United States, conspired to raise, maintain, or stabilize the prices for titanium dioxide.
Eric L. Cramer and Daniel Walker led the Berger Montague team. In 2011, the United States District Court for the District of Maryland denied the defendants’ motions to dismiss. In 2012, the court certified a class of titanium dioxide direct purchasers, and in 2013, the court denied the defendants’ motions for summary judgment. The parties thereafter reached settlements totaling $163.5 million that were approved by the court.
