Reitzi v. Vans Express, Inc. and DHL Express (USA) Inc. d/b/a DHL Express – Unpaid Overtime Settlement

Berger Montague served as lead counsel and obtained a $650,000 settlement in this wage and hour lawsuit against Vans Express, Inc. and DHL Express Inc. d/b/a DHL Express on behalf of approximately 340 individuals employed in the United States as non-exempt delivery drivers or couriers during the time period at issue. Piazza of Berger Montague, the plaintiffs brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq., and Pennsylvania Labor Laws. The case was litigated in the United States District Court for the Northern District of Florida and was captioned Reitzi v. Vans Express, Inc. and DHL Express (USA) Inc. d/b/a DHL Express, No. 1:21-cv-01514 (M.D. Pa.)

The plaintiffs were non-exempt, hourly paid delivery drivers who were not paid for all hours worked, including overtime compensation to which they were entitled under the law. Plaintiffs routinely worked through meal breaks and rest breaks without proper compensation and, therefore, were not paid for all hours worked and were not paid overtime for hours worked well over forty (40) per workweek. The settlement resolved the claims alleged in the action.
