Riviere v. Blue Cross and Blue Shield of Florida, Inc. et al. – Unpaid Overtime Settlement

Berger Montague served as co-lead counsel and obtained a $25,000 settlement in this wage and hour lawsuit against Blue Cross and Blue Shield of Florida, Inc., GuideWell Mutual Holding Corporation, and Health Options, Inc. on behalf of the Plaintiff who was employed as a non-exempt employee during the time period at issue. Led by Camille Fundora Rodriguez of Berger Montague, the plaintiff brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq. (“FLSA”). The case was litigated in the United States District Court for the Northern District of Florida and was captioned Riviere v. Blue Cross and Blue Shield of Florida, Inc. et al., No. 1:20-cv-23709-ALTONAGA/GOODMAN (S.D. Fla.)

Plaintiff was a Utilization Review Nurse who was allegedly misclassified as exempt and, therefore, was not paid overtime compensation. Plaintiff routinely worked well over forty (40) hours per workweek with no overtime pay for hours worked in excess of forty. Plaintiff primarily claimed that she was improperly classified as exempt from the FLSA and, as a result, did not receive overtime pay for hours worked in excess of forty (40) in a workweek.
