The case is pending in the United States District Court for the Southern District of New York and captioned Sun v. TAL Education Group, et al., No. 1:22-cv-01015 (S.D.N.Y.) (Carter, J.).

Mississippi was appointed Co-Lead Plaintiff with the New Mexico State Investment Council. Lead Plaintiffs’ claims arise from a series of alleged materially false and misleading statements made by the defendants from April 26, 2018 through July 22, 2021, concerning TAL’s core business, including its adherence to Chinese regulations governing the private, after school for-profit tutoring industry, its ability to comply with those regulations, the causes for its increasing student enrollment and financial success, and the characterization of those regulations as “beneficial.” TAL told the investing public that it complied with these critical regulations, however, the plaintiffs allege that it intentionally failed to do so to fuel its rapid growth, contributing to a shut-down of the industry and TAL’s profitable tutoring business. The defendants’ motions to dismiss are fully briefed and the motion is pending. Michael Dell’Angelo, Barbara Podell and Andrew Abramowitz of Berger Montague are responsible for this matter.
