Berger Montague served as lead and liaison counsel and obtained a $25 million settlement in 1981 for a class of individuals, businesses, and other entities who suffered property damages and economic losses as a result of the Three Mile Island nuclear incident. The case was litigated in the United States District Court for the Middle District of Pennsylvania and captioned In re Three Mile Island Litigation, No. 79-0432 (M.D. Pa.). Firm founder David Berger was principal counsel and achieved the first legal recovery of millions of dollars for economic harm caused by the nation’s most serious nuclear accident. As part of the award in the case, Mr. Berger established a committee of internationally renowned scientists to determine the effects on human beings of emissions of low-level radiation.
