The case was litigated in the United States District Court for the Middle District of Pennsylvania and captioned In re Three Mile Island Litigation, No. 79-0432 (M.D. Pa.). Firm founder David Berger was principal counsel and achieved the first legal recovery of millions of dollars for economic harm caused by the nation’s most serious nuclear accident. As part of the award in the case, Mr. Berger established a committee of internationally renowned scientists to determine the effects on human beings of emissions of low-level radiation.
