Berger Montague served as co-lead counsel and obtained settlements of over $110 million for retirees of Unisys Corp. whose health benefits were terminated. Led by Todd S. Collins of Berger Montague, the plaintiffs alleged that the defendant Unisys Corp. engaged in breaches of fiduciary duty established by the Employee Retirement Income Security Act of 1974 (“ERISA”), as well as other ERISA violations. During the litigation, Berger Montague handled the presentation of over 70 witnesses, 30 depositions, and over 700 trial exhibits. The case was litigated in the United States District Court for the Eastern District of Pennsylvania and captioned In re Unisys Corp. Retiree Medical Benefits Litigation, MDL No. 969 (E.D. Pa.).
