In 1997, Berger Montague filed a class action complaint that was different from the complaints filed by any other of the filing law firms in the New Jersey State Court “Fen Phen” class action. The class sought in the firm’s complaint was ultimately certified.

Berger Montague’s case was the only case anywhere in the country to include a claim for medical monitoring.

In the midst of trial, the New Jersey case was folded into a national settlement which occurred as the trial was ongoing. The settlement, which occurred in 1999, was structured to include a medical monitoring component worth in excess of $1 billion.
