Berger Montague Secures Final Approval of $10.5M Lemonade Data Breach Settlement

Berger Montague, a leading national plaintiff-side law firm, serves as Co-Lead Class Counsel in a $10.5 million settlement representing more than 190,000 consumers whose personal information was put at risk by Lemonade.

“This holds Lemonade accountable and delivers real, tangible relief to the nearly 200,000 consumers whose driver’s license numbers were put at risk,” said Shareholder Mark DeSanto. “Driver’s license numbers are among the most sensitive pieces of identity information a company can hold, and this $10.5 million settlement ensures Class Members can recover for documented losses, receive cash payments, and access meaningful credit monitoring and identity protection going forward.”

A federal judge in the U.S. District Court for the Southern District of New York has granted final approval of the $10.5 million settlement. U.S. District Judge Jennifer H. Rearden approved the settlement on September 10, 2026, following a final approval hearing in Manhattan. The settlement resolves In re Lemonade, Inc. Data Disclosure Litigation.

The lawsuit alleged that a vulnerability in Lemonade’s online insurance-quote platform allowed unauthorized third-party access to driver’s license numbers belonging to approximately 190,000 individuals between April 2023 and September 2024, in violation of the federal Driver’s Privacy Protection Act. Under the settlement, eligible Class Members may recover up to $10,000 for documented out-of-pocket losses, a pro rata cash payment from the remaining net settlement fund, and three years of credit monitoring and identity theft protection services valued at nearly $720 per person. Lemonade has also agreed to implement enhanced data security measures to help prevent future incidents.
