Google Antitrust Class Action Lawsuit Receives Class Certification
Berger Montague, a leading national plaintiffs’ law firm, and co-counsel Boies Schiller Flexner LLP and Korein Tillery LLC won a decision granting certification of a class of thousands of internet publishers in a multidistrict antitrust litigation concerning Google’s advertising technology.
“This litigation is about Google’s use of its dominance over the tools publishers use to sell ad space on their websites to advertisers to squeeze out rivals and overcharge publishers,” said Firm Chairman Eric Cramer, who is leading the team on this case for Berger Montague. “The class ruling is a significant step toward trial where the publisher class expects to convince a jury in Manhattan that Google’s anticompetitive conduct has illegally inflated the costs of selling ad space, reduced the revenues these publishers can generate, and thereby diminished the vibrancy of the open web for consumers.”
The class certification order, December 12, 2025, applies to Google’s advertising technology used by publishers to sell ad space through Google’s AdX ad auction platform, which tools publishers use to manage and sell their ad space to advertisers.
The Berger Montague team includes Eric L. Cramer, Michael Dell’Angelo, Patrick F. Madden, Robert E. Litan, and Jeremy Gradwohl. The class certification ruling was recognized by Law360’s Legal Lions of the Week.
U.S. District Judge Kevin P. Castel certified the class approving The Nation Co. LLC and Genius Media Group Inc. as class representatives. Read more about the decision here.
