New York Times Covers Berger Montague Antitrust Suit Alleging Expedia Inflated Hotel Prices
The New York Times featured today an antitrust class action brought by Berger Montague, a leading national plaintiff law firm, alleging that Expedia Group, Inc. pushed millions of consumers to overpay for hotel stays by as much as 30 percent. The article, “Feel Like You’re Overpaying for Hotels? Blame Expedia, a New Lawsuit Says,” examines claims that Expedia used its dominance in online hotel booking to keep room rates artificially high, even for travelers who never book through Expedia.
“Our Complaint alleges that when hotels can’t offer travelers a better price, everyone pays more,” said Chairman Eric L. Cramer. “We intend to prove that Expedia’s contract terms and pricing algorithms have taken price competition out of the hotel market, and this lawsuit seeks to restore it so consumers get the lower rates a competitive market would deliver.”
The complaint, filed October 2, 2026, in the U.S. District Court for the Western District of Washington, alleges that Expedia violated Sections 1 and 2 of the Sherman Act. Plaintiffs allege that Expedia, which the Complaint alleges facilitates nearly 80 percent of U.S. online travel agency hotel bookings by value, prohibits hotels from offering lower rates on their own websites and uses algorithms to demote hotels in its search results when they offer lower prices on rival sites such as Booking.com. The lawsuit seeks damages and a court order ending these practices on behalf of two proposed nationwide classes of consumers who booked U.S. hotel stays directly with hotels or through rival booking sites since October 2, 2022.
Berger Montague attorneys Eric L. Cramer, Dennie Zastrow, and Robert E. Litan represent the plaintiffs alongside co-counsel Terrell Marshall Law Group PLLC and Freedman Normand Friedland LLP.
