Proving Your Claim(s) Against American Eagle and Aerie

This page will help you locate false and misleading emails as needed to prove your claim against American Eagle and/or Aerie. To proceed with your claim, you must provide proof that you received at least one email with a misleading subject line from each retailer you have a claim against.

Providing proof is easy. Simply search your inbox for (1) one of the emails listed below, OR (2) another email with a misleading subject line. Please provide the oldest misleading email you received that is within the statute of limitations (2.5 years ago if you are a Maryland resident and 3.5 years ago if you are a Washington resident). We will rely on that date to calculate the time the statute allows you to bring a claim.

1. The emails listed below are real emails with subject lines that have been verified to be false or misleading. To find one of the emails, go to your email provider and search for emails from American Eagle or Aerie (e.g., “from: American Eagle” or “from: Aerie”). Then scroll to the dates listed below. If you see one of the email subject lines below within a day or two of the date listed, you can either take a screenshot of the email and upload it HERE OR forward the email to us at AmericanEagleClaims@bergermontague.com.

2. To search for another email, go to your email provider and search for emails from American Eagle or Aerie that say extended (e.g., “from: American Eagle” and “extended” or “from: Aerie” and “extended”). If you see “extended” in the subject line, you can either take screenshots of the emails and upload them HERE OR forward them to us at AmericanEagleClaims@bergermontague.com.  If we are unable to verify that the email you provided has a false or misleading subject line, we may ask for additional proof.
