Case Number: No. 94 C 897
Practice Area: Antitrust
Case Status: Settled
Settlement Amount: $717 million
Court: United States District Court for the Middle District of Illinois
Berger Montague served as Co-Lead Counsel and obtained a $717 million settlement in this antitrust price-fixing class action on behalf of a class of purchasers of brand name prescription drugs. Led by H. Laddie Montague, Jr. and Peter R. Kahana, the case was litigated in the United States District Court for the Northern District of Illinois, and resulted in one of the most significant antitrust victories in U.S. history.
From Judge Charles P. Kocoras of the U.S. District Court for the Northern District of Illinois:
“The stakes were high here, with the result that most matters of consequence were contested. There were numerous trips to the courthouse, and the path to the trial court and the Court of Appeals frequently traveled. The efforts of counsel for the class has [sic] produced a substantial recovery, and it is represented that the cash settlement alone is the second largest in the history of class action litigation…. There is no question that the results achieved by class counsel were extraordinary[.]”
