On September 5, 2025, Plaintiffs Marjorie Cruz and Melissa Gary filed a class action complaint on behalf of themselves and other non-exempt hourly employees against the CommuniCare Family of Companies under the Fair Labor Standards Act (“FLSA”) and Indiana state law, for failure to pay all wages. Specifically, CommuniCare allegedly failed to pay overtime for all hours worked in excess of forty (40) hours in a workweek.
