Diaz v. TAK Communications CA, Inc., et al. – Unpaid Overtime Settlement

Berger Montague served as co-lead counsel and obtained a $1.2 million settlement in this wage and hour lawsuit against TAK Communications CA, Inc. and TAK Communications, Inc. on behalf of approximately 770 individuals employed in the United States as Technicians during the time period at issue. Piazza of Berger Montague, the plaintiffs brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq. (“FLSA”) and California Labor Laws. The case was litigated in the Superior Court of California for the County of Alameda and was captioned Diaz v. TAK Communications CA, Inc., et al., Superior Court of California, County of Alameda, Case Number RG20064706.

The plaintiffs were non-exempt, hourly paid Technicians for TAK who were not provided meal and rest breaks, were not compensated for all hours worked, were not paid minimum, straight time, overtime, or double time wages, were not paid all wages due upon termination, were not provided timely and compliant itemized wage statements, and were not reimbursed for necessary business expenses. The settlement resolved the claims alleged in the action.
