Settlement Amount: $170 million
Court: United States District Court for the Central District of California
Berger Montague served on the Executive Committee and helped obtain a settlement valued at over $170 million. The settlement included a $22 million non-reversionary cash settlement fund as well as remedial measures and two years of free credit monitoring and identity theft insurance. Under the settlement, class members were entitled to recover cash payments relating to (1) reimbursements of fraud losses; (2) reimbursements of costs incurred in responding to the data breach; and (3) compensation for time spent in connection with the data breach calculated at $20 per hour and capped at two hours for undocumented time or seven hours for documented time.
In approving the settlement, the Court commented that it was an “excellent result” for the class.
Berger Montague initially filed the case on behalf of 15 million consumers in the United States whose personal information was stolen including names, addresses, Social Security numbers, military ID numbers, and passport numbers. The data belonged to consumers who applied for T-Mobile mobile phone service during the period at issue. T-Mobile routed the information to Experian during the credit approval process. The plaintiffs alleged claims against the defendants for failing to implement and maintain adequate data security practices to safeguard personally identifiable information (PII), and failing to detect the privacy breach in a timely manner. All of the consolidated cases were thereafter litigated in the United States District Court for the Central District of California.
