Berger Montague served as co-lead counsel and obtained a $2.45 million settlement in this wage and hour lawsuit against Divurgent, LLC, on behalf of approximately 1,065 individuals employed in the United States as Consultants during the time period at issue. Led by Shanon J. Carson and Alexandra K. Piazza of Berger Montague, the plaintiffs brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq. (“FLSA”) and the Massachusetts Overtime Law, Mass. Gen. L. c. 151 § 1B. The case was litigated in the United States District Court for the Eastern District of Virginia and was captioned Hatzey v. Divurgent, LLC, No. 1:17-3237 (E.D. Va.).
The plaintiffs were non-exempt, hourly paid Consultants who were staffed by Divurgent to provide support and training to hospital staff in connection with training on new electronic recordkeeping systems. Plaintiffs routinely worked well over forty (40) hours per workweek, throughout the duration of their assignments, and were paid only a straight hourly rate, with no overtime pay for hours worked in excess of forty. Plaintiffs primarily claimed that they were denied overtime pay at 1.5 times their regular rate as required by the FLSA and applicable state laws. The settlement resolved the claims alleged in the action.
