On December 20, 2024, Berger Montague was appointed Co-lead Counsel in a proposed class action In Re: Shale Oil Antitrust Litigation. On January 10, 2025, Berger Montague and its Co-lead Counsel filed a Consolidated Class Action Complaint (“CCAC”) on behalf of end-purchasers of crude oil derivative fuel products from January 2021 to the present. The CCAC alleges that the major producers of domestic shale oil conspired to constrain production, which had the effect of fixing or raising the price paid by end-users of crude oil derivative products. Defendants are among the largest domestic shale oil producers, including Permian Resources Corp., f/k/a Centennial Resource Development, Expand Energy Corporation, f/k/a Chesapeake Energy Corporation, Continental Resources Inc., Diamondback Energy, Inc., EOG Resources, Inc., Hess Corporation, Occidental Petroleum Corporation, and Pioneer Natural Resources Company. |
On February 24, 2025, Defendants moved to dismiss the CCAC. Berger Montague and Co-Lead Counsel opposed Defendants’ motions on April 10, 2025. The Court held argument on Defendants’ motions to dismiss on May 20, 2025.
