The lawsuits allege a multi-year conspiracy among the largest egg producers that caused egg prices to skyrocket. Specifically, the complaints detail how the egg producers manipulated a widely used pricing benchmark, the Urner Barry Egg Index, to inflate the market-wide price of shell eggs. The complaints also allege that the egg producers used avian flu infections as a pretext to limit egg production, further bolstering inflated egg prices. Plaintiffs’ economic analyses demonstrate that the rapidly rising egg prices seen during the conspiracy cannot be explained by competitive market forces like supply, demand, and costs and instead reflect coordinated manipulation of price formation and industry output.

The defendants are Cal-Maine Foods, Inc.; Daybreak Foods, Inc.; Hillandale Farms of PA, Inc.; Hillandale-Gettysburg, L.P.; Rose Acre Farms, Inc.; Opal Foods, LLC; Versova Holdings LLP; Urner Barry Publications, Inc. d/b/a Expana; Egg Clearinghouse, Inc.; and United Egg Producers d/b/a Egg Farmers of America.
