Koszyk et al. v. Country Financial a/k/a CC Services, Inc. – Unpaid Overtime Settlement

Berger Montague served as co-lead counsel and obtained a $2.825 million settlement in this wage and hour lawsuit against Country Financial a/k/a CC Services, Inc. on behalf of approximately 1,381 individuals employed in the United States as Financial Representatives during the time period at issue. Piazza of Berger Montague, the plaintiffs brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq. (“FLSA”). The case was litigated in the United States District Court for the Northern District of Illinois and was captioned Koszyk et al. v. Country Financial a/k/a CC Services, Inc., No.1:16-cv-03571 (N.D. Ill.).

The plaintiffs were salary paid Financial Representatives who were required by Country Financial to complete the Country Financial training program, including the Country Agency Learning (“CAL”) class, as a condition of their employment. Plaintiffs routinely worked well over forty (40) hours per workweek during their sixty (60) day training period and were expected to work sixty (60) or more hours per week, throughout the duration of their training, and were paid only their base salary, with no overtime pay for hours worked in excess of forty. Plaintiffs primarily claimed that they were improperly classified as exempt employees during their training period and were not paid an overtime rate when they worked more than forty (40) hours per week. The settlement resolved the claims alleged in the action.
