Piazza of Berger Montague, the plaintiffs brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq. The case was litigated in the United States District Court for the Western District of Oklahoma and was captioned Lopez v. T/J Inspection, Inc., No. 5:16-cv-00148-M (W.D. Okla.).
Plaintiff and collective members were non-exempt Inspectors paid a daily rate who were employed by T/J Inspections to perform inspections on oil and gas pipelines for energy, public utility, and pipeline companies. Plaintiffs routinely worked well over forty (40) hours per workweek, throughout the duration of their assignments, and were paid only a straight daily rate, with no overtime pay for hours worked in excess of forty. Plaintiff primarily claimed that Inspectors were not paid an overtime rate when they worked more than forty (40) hours per week. The settlement resolved the claims alleged in the action.
