On May 16, 2025, Plaintiff Lynn MacArthur filed a class action complaint on behalf of all “manual workers” at Atlanticare Management, LLC d/b/a Putnam Ridge Nursing Home under the Fair Labor Standards Act (“FLSA”)and New York Labor Law (“NYLL”).
Specifically, Atlanticare failed to pay manual workers on a weekly basis as required by the NYLL, and working through meal periods off-the-clock without pay, and not providing spread of hours pay for working split-shifts or shifts lasting more than 10 hours.
