The plaintiffs alleged that the defendant, Mutual of Omaha Insurance Co., violated the Employee Retirement Income Security Act, 29 U.S.C. § 1000, et seq., (“ERISA”) concerning retirement plans by causing Mutual of Omaha Retirement Income Plan participants to pay excessive, unnecessary fees, or by including unwise and imprudent investment options among the plan options.
