Lechner v. Mutual of Omaha Insurance Co. – ERISA Class Action Settlement

Berger Montague served as co-lead counsel and obtained a $6.7 million settlement on behalf of current and former Mutual of Omaha employees who participated in Mutual of Omaha’s Retirement Income Plan or a similar retirement plan. Mutual of Omaha Insurance Co., et al., No. 8:18-cv-00022 (D. Neb.).

The plaintiffs alleged that the defendant, Mutual of Omaha Insurance Co., violated the Employee Retirement Income Security Act, 29 U.S.C. § 1000, et seq., (“ERISA”) concerning retirement plans by causing Mutual of Omaha Retirement Income Plan participants to pay excessive, unnecessary fees, or by including unwise and imprudent investment options among the plan options.
