Berger Montague and co-counsel filed this class action on June 9, 2017 and thereafter filed a First Amended Complaint on September 15, 2017 adding additional plaintiffs. Plaintiffs alleged that 2010-2015 Cadillac SRX vehicles contain a defect that causes their headlights to wear out and fail unexpectedly and prematurely.
GM filed its motion to dismiss on October 16, 2017. After the unfortunate passing of the original judge assigned to the matter and reassignment to Judge Terry Hatter, the court issued an order regarding Defendant’s Motion to Dismiss on August 8, 2018. The court sustained Plaintiff Steele’s claims in their entirety but struck certain of the Campos Plaintiffs’ claims.
Thereafter, the parties engaged in discovery and the court set a “Final Pre-Trial Conference” conference for December 3, 2018. Prior to that date, the parties mediated and thereafter resolved the litigation in a confidential settlement providing for broad relief. Russell Paul, Amey Park and Abigail Gertner were responsible for this matter.
