Berger Montague and cocounsel filed this class action on April 23, 2019. Plaintiffs alleged that General Motors’ recent generation of half-ton “K2XX platform” trucks and SUVs that causes certain Vehicles to shake violently at cruising speeds. Consumers have named this defect the “Chevy Shake.”
These vehicles include 2014-2019 Chevrolet Silverado 1500s, 2015-2020 Cadillac Escalades, 2015-2020 Chevrolet Suburbans, 2015-2020 Chevrolet Tahoes, 2014-2019 GMC Sierras, and 2015-2020 GMC Yukon/Yukon XLs. GM filed its motion to dismiss on June 17, 2019.
Case Details
Plaintiff’s opposition was filed on July 15, 2019 and the Defendant’s reply was filed on July 29, 2019. GM filed a Motion to Stay Discovery Pending Resolution of the Motion to Dismiss on July 25, 2019, which was fully briefed. On October 22, 2019, the Court issued an Order granting in part and denying in part Defendant’s Motion to Dismiss and denying as moot Defendant’s Motion to Stay Discovery.
GM answered the Complaint on November 11, 2019. On March 2, 2020, the parties jointly filed a Motion for a Revised Scheduling Order, requesting that the Court extend by six months the remaining deadlines set forth in the Court’s July 30, 2019 Scheduling Order.
Settlement and Legal Assistance
The Court extended the deadlines requested, but by less than six months. The Court extended the fact discovery deadline to May 11, 2020. After that date, the parties mediated and thereafter resolved the litigation in a confidential settlement. Russell Paul, Amey Park and Abigail Gertner were responsible for this matter.
