On September 23, 2024, a federal judge tapped a team of lawyers from Berger Montague PC, Edelson PC, and Susman Godfrey LLP to take the lead for the class action plaintiffs in consolidated multidistrict litigation (“MDL”) accusing MultiPlan and many large insurers of colluding to systematically underpay out-of-network healthcare providers.

U.S. District Judge Matthew Kennelly chose Berger Montague, Susman Godfrey, and Edelson as co-lead counsel from among several competing bids stating that the team is well-qualified and their proposal “made the most sense.”

The MDL stems from a flurry of federal cases filed after investigations and reporting by The New York Times and others on MultiPlan and potential collusion in health care pricing. All such actions were centralized by the U.S. Judicial Panel on Multidistrict Litigation before Judge Kennelly in the U.S. District Court for the Northern District of Illinois. Now that Judge Kennelly has ruled on plaintiffs’ leadership, this case will shift into substantive pretrial matters.

How might I benefit from seeking representation?

Our firms will bring claims on your behalf and any fees and costs will be covered during the litigation. The case will be taken on a contingent basis, and as such no fees will be charged to the healthcare providers until we win.

What will this cost me?

The attorneys will represent you on a contingency basis, meaning they will get paid only if you obtain a monetary recovery. If you do not obtain any money, you will not pay attorney’s fees or costs, or costs incurred. If you do obtain a monetary recovery, costs will be taken out of the recovery and the attorneys will receive a contingency fee (identified in the assignment agreement). In this way, the attorneys are undertaking substantial financial risk by pursuing these claims, and the contingency fee agreement aligns the lawyers’ interests with yours.

How much money can I hope to recover?

Legal investigations and arbitration are unpredictable. The providers may not obtain any recovery at all. On the other hand, you may recover a significant amount. What we can say is that the Law Firms will do their best to obtain compensation for you.

What is multidistrict litigation (“MDL”) and is it different from a class action lawsuit?

A MDL is where similar – but not necessarily the same – cases pending against a defendant are gathered under one federal judge. It may take more than one trial to resolve all the cases involved in an MDL, but that one judge’s court will decide them.
A class action lawsuit is different in that it involves several people – injured under similar facts – gathering in a single lawsuit against the same defendant.
