Berger Montague Files Class Action Alleging McDonald’s and Deloitte Fixed Menu Prices

Berger Montague, a leading national plaintiff law firm, announces that it has filed Rossi v. McDonald’s Corporation, et al., a proposed class action alleging that McDonald’s, its franchisees, and Deloitte Consulting conspired to fix menu prices at McDonald’s restaurants nationwide through an “algorithmic” pricing system.

“Every McDonald’s restaurant is supposed to set its own prices,” said Shareholder Zachary Caplan. “Instead, as the complaint alleges, McDonald’s built a system that pools competing restaurants’ confidential data, generates their prices, and makes sure they follow along—and consumers have been paying for it at the counter.”

Berger Montague represents plaintiff Meredith Rossi and the proposed class in the case, filed October 15, 2026, in the U.S. District Court for the Northern District of Illinois. The complaint alleges that since at least 2019, McDonald’s company-owned and franchised restaurants—which McDonald’s has said compete with one another—have priced their menus using a single McDonald’s-controlled pricing tool that pools competing restaurants’ confidential sales data to generate item-by-item, restaurant-by-restaurant price recommendations. According to the complaint, Deloitte delivers those recommendations to franchisees, and McDonald’s monitors and enforces adherence through its franchisee business reviews.

The complaint alleges that the average McDonald’s menu item cost about 40 percent more in 2024 than in 2019, and that a McDonald’s chief financial officer told investors the company was “seeing very strong adherence with our franchisees to our pricing recommendations.” The suit asserts claims under Section 1 of the Sherman Act and seeks treble damages and injunctive relief on behalf of all persons and entities in the United States that purchased menu items from a McDonald’s restaurant since January 1, 2019.
