Berger Montague Wins for California Child Support Recipients
Berger Montague, a leading national plaintiffs’ law firm, won a class action on behalf of California child support recipients who were charged an average of $40 in fees for basic customer service related to the Way2Go pre-paid debit cards provided by Defendants Conduent State and Local Solutions, Inc. and Comerica Bank.
The court granted the Class’s motion for summary judgment, awarding the class full restitution, equaling over $7.6 million, and issued an injunction prohibiting Defendants from imposing the fees on child support recipients in the future. The win represents a novel application of California’s Unfair Competition Law’s to reach fees imposed under contracts of adhesion.

U.S. District Judge Daniel J. Calabretta noted in the summary judgment order that the state already pays defendants to operate the automated help line. California child support recipients were charged fifty cents per call after three free calls each month. Judge Calabretta rejected the argument that the fees were de minimis, noting the cumulative impact of fees paid by recipients over a five-year period. Defendants have appealed the decision.
