Biography

Tyler Planeta is Senior Counsel in Berger Montague’s Toronto office, where his practice centers on complex class action litigation, with a particular focus on securities and competition matters. He has appeared before all levels of court in Ontario and British Columbia, as well as before the Supreme Court of Canada.

Since 2025, Best Lawyers has recognized Mr. Planeta as a Best Lawyers: Ones to Watch in Canada for Class Action Litigation.

Mr. Planeta’s work representing investors in securities class actions—including in cases against Just Energy Group, Gatos Silver, Canadian Solar, Manulife Financial, and SouthGobi Resources—has collectively resulted in settlements exceeding $130 million.

Beyond securities litigation, Mr. Planeta has built a broad and varied practice extending to human rights, institutional abuse, and product liability litigation. He has represented refugees who alleged enslavement at a Canadian-owned mine in Eritrea, and children who alleged abuse at a for-profit group home. He was also part of the team that certified Canadian claims against Syngenta over paraquat exposure and successfully defended certification on appeal. He has represented Canadian consumer groups in two landmark Supreme Court of Canada decisions.

Before joining Berger Montague, Mr. Planeta was a partner in a prominent class actions practice. He also worked for a litigation funding firm in Dublin, Ireland, where he helped manage complex securities and competition claims in Europe and Asia.
Mr. Planeta is actively involved in his community and regularly takes on pro bono matters, including as a volunteer lawyer with the Osgoode Hall Investor Protection Clinic, and as a volunteer judge for the Winkler Class Actions Moot. He has served as an elected Member-at-Large of the Ontario Bar Association’s Class Actions Section.

Mr. Planeta is a graduate of the Queen’s University Faculty of Law and the University of Waterloo, and a member of the Law Society of Ontario, the Law Society of British Columbia, and the Advocates’ Society.

Prominent Judgments & Settlements

  • Gilchrist v Just Energy Group, CV-19-627174-00CP (Ontario Superior Court). Counsel to plaintiffs in a securities class action arising out of alleged accounting errors, which settled for US $25 million.
  • Gionet Estate v Syngenta AG, S217598 (Supreme Court of British Columbia). Counsel to representative plaintiffs in successfully certifying a class proceeding arising out of exposure to paraquat products. Certification was upheld on appeal.
  • Przybylska v Gatos Silver, Inc., CV-22-00676682-00CP (Ontario Superior Court). Counsel to representative plaintiff in a class proceeding alleging errors in a mining company’s mineral reserve statement, which settled for $5.16 million.
  • Ironworkers Ontario Pension Fund v Manulife Financial, CV-09-383998-CP (Ontario Superior Court). Counsel to plaintiffs in securities litigation alleging misrepresentations in disclosures relating to risk-management systems; part of the team that secured a $69 million settlement for class members.
  • Abdula v Canadian Solar, C-710-10 (Ontario Superior Court). Counsel to plaintiff in securities litigation arising out of alleged deficiencies in financial reporting and internal controls; part of the team that secured a US $13 million settlement for class members.
  • Araya v Nevsun (Supreme Court of British Columbia). Part of the team that litigated a landmark mass tort case arising out of alleged human rights violations at a Canadian-owned mine in Eritrea.
  • Rahimi v SouthGobi Resources Ltd, CV-14-495869-00CP (Ontario Superior Court). Counsel to plaintiff in a securities class proceeding arising out of alleged revenue recognition errors; part of the team that secured settlements totaling over $7.5 million for class members.
  • TELUS Communications Inc v Wellman, 2019 SCC 19 (Supreme Court of Canada). Counsel to the Consumers’ Association of Canada in a leading case involving the interaction of provincial arbitration legislation and class proceedings.
  • R v Comeau, 2018 SCC 15 (Supreme Court of Canada). Counsel to the Consumers Council of Canada in a leading case involving interprovincial trade.
