On September 3, 2025, Plaintiffs Dennis Larkin and Danielle Gosline filed a class action lawsuit against Caremark RX, L.L.C. (“CVS Caremark”) under the Employee Retirement Income Security Act of 1974 (“ERISA”). Plaintiffs belong to an employer-sponsored health benefit plan for which CVS Caremark acts as a pharmacy benefit manager (“PBM”). Plaintiffs’ requests for coverage of Zepbound (tirzepatide) were denied by CVS Caremark due to alleged lack of medical necessity and not being covered under the plan, in violation of ERISA and the terms of the applicable plan documents.
