Berger Montague’s record of success is a direct reflection of the firm’s philosophy that we prepare the case for trial from the first moment that we take on a new matter.
In each new case, Berger Montague begins thinking about the trial immediately, and we pay attention to the details that other firms miss. We approach each case as if it is going to be tried to a jury, and our commitment to prosecuting cases through trial is known to defense firms across the country. Our reputation of being lawyers who will take the case to trial helps our clients achieve successful settlements and recoveries, precisely because our opponents know that we are not afraid to bring the case to a jury. Our history and experience are clear and always in the minds of our opponents. Since its founding, Berger Montague has played a principal role in obtaining over $50 billion in settlements and verdicts, including, just for example:
- $5.6 billion in the Payment Card Antitrust Litigation;
- $4.5 billion in Nazi-era cases against German defendants;
- $3.6 billion in Connecticut’s tobacco litigation;
- $2.0 billion in the Drexel Burnham Lambert Group Litigation;
- $1.3 billion in the Michael Milken Litigation;
- $1.2 billion-plus in Holocaust Victims’ / Swiss Banks;
- $717 million in the Brand Name Prescription Drugs Litigation;
- $531 million in the high fructose corn syrup litigation;
- $505 million in the Exxon Valdez litigation ($5 billion jury verdict before appeal);
- $475 million in the Merrill Lynch securities litigation.
In fact, Berger Montague has twice won the prestigious “Trial Lawyer of the Year Award” designated by The Public Justice Foundation:
- In 2009, the Trial Lawyer of the Year Award went to Berger Montague in the Rocky Flats Nuclear Weapons Plant Litigation case for a “long and hard-fought” victory against “formidable corporate and government defendants.” The Berger Montague team tried the case and won a $554 million jury verdict – the largest trial verdict in Colorado history – for thousands of property owners whose homes were exposed to plutonium or other toxins. With interest, the judgment totaled $926 million.
- In 1995, the Trial Lawyer of the Year Award went to Berger Montague for its work as trial counsel for the plaintiffs and class in the Exxon Valdez Oil Spill Litigation, in which the jury awarded $5 billion (later reduced to $505 million by the U.S. Supreme Court).
