Berger Montague served as co-lead counsel and obtained a $19.74 million settlement in this wage and hour lawsuit against Ascension Health and Sacred Heart Health System, Inc., et. al. (“Ascension”) on behalf of approximately 84,600 individuals employed in the United States as non-exempt healthcare professionals.

Piazza of Berger Montague, the plaintiffs brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq. (“FLSA”) and applicable state laws. The case was litigated in the United States District Court for the Northern District of Florida and was captioned Anstead, et al. v. Ascension Health, et al., No. 3:22-cv-02553-MCR-HTC (N.D. Fla.)
The plaintiffs were non-exempt healthcare professionals who alleged that: (a) Ascension improperly excluded nondiscretionary bonuses from their regular rate of pay when in calculating overtime compensation when they worked more than forty (40) hours per week; and (b) a Kronos ransomware attack that took place between November 2021 and January 2022 affected their wages and overtime compensation during three pay periods. Specifically, Plaintiffs alleged that Ascension’s critical staffing bonuses were not properly included when it calculated the “regular rate” for purposes of calculating the overtime rate, and therefore, the amount of overtime compensation paid was incorrect in violation of the Fair Labor Standards Act (“FLSA”) and applicable state wage and hour laws.
The settlement resolved the claims alleged in the action for the time period between March 2, 2019, and June 13, 2022.
