Berger Montague is co-lead plaintiffs’ counsel representing those who had their sensitive data shared in the largest data breach in 2023. The case involves a data breach carried out by a group of Russian cyberthieves that impacted approximately 85 million Americans.
This complex Multi-District Litigation (MDL) involves the 2023 hack of Progress Software’s MOVEit file transfer platform by the Russian ransomware gang Cl0p, which targeted a zero-day vulnerability in the MOVEit software. More than 1,000 organizations, large and small, were affected, leading to over 100 class action lawsuits being filed.
In January of 2024, Ms. Drake was selected over dozens of other applicants from top firms to be one of five co-lead plaintiffs’ counsel. On December 12, 2024, U.S. District Judge Allison Burroughs denied an omnibus motion to dismiss filed on behalf of Progress, federal contractor Maximus Health Services and others, concluding that most of the plaintiffs had plausibly alleged they have suffered harm as a result of the breach.
On December 6, 2024, the plaintiffs also filed a detailed and extensive bellwether consolidated class action complaint, which will be subject to forthcoming motion practice and discovery.
