Berger Montague and co-counsel serve as putative class counsel on behalf of a proposed class of owners and lessees of 2014 or newer Chrysler, Dodge, Jeep, or RAM-branded vehicles equipped with a 3.6L Pentastar V6 engines, alleging that the engines in these vehicles have defective valve train systems which cause the engines to premature fail. 

Other symptoms of the defective valve train system include noticeable ticking noises from the engine, bucking, surging, lurching, and loss of power, leaving consumers needing to replace valve train components or their engines well before the useful life of these components would be expected. 

The vehicles at issue (“Class Vehicles”) include the following:

  • 2014-2016 Chrysler Town & Country; 
  • 2014-2019 Dodge Journey;
  • 2014-2022Dodge Challenger; 
  • 2014-2022Dodge Charger; 
  • 2014-2022Dodge Durango; 
  • 2014-2020 Dodge Grand Caravan; 
  • 2014-2022 Jeep Grand Cherokee; 
  • 2014-2022Chrysler 300; 
  • 2014-2022 Jeep Wrangler; 
  • 2020-2022 Jeep Gladiator; 
  • 2014-2017 Chrysler 200; 
  • 2014-2022 Dodge Ram 1500; 
  • 2014-2022 Ram ProMaster; 
  • 2017- 2022 Chrysler Pacifica; 
  • 2014 Dodge Avenger; and
  • 2020-2022 Chrysler Voyager.

Maugain et al., v. FCA US LLC: Case Update

Plaintiffs allege that FCA marketed, distributed, and sold the Class Vehicles which are not fit for providing safe and reliable transportation. The case is pending in the United States District Court for the District of Delaware.

On February 7, 2023, Judge Gregory B. Williams issued an opinion denying in part and granting in part Defendant’s Motion to Dismiss. Berger Montague, including the team of Russell D. Paul, Abigail J. Gertner, Amey J. Park, and Natalie Lesser, are currently in the midst of intensive fact discovery.  On February 17, 2023, Plaintiffs filed a Motion for Reargument to revive certain dismissed claims and are awaiting the Court’s decision on that Motion.
