Milisits, et al. v. FCA US LLC

Berger Montague represents plaintiffs pursuing claims for breaches of warranty, violations of consumer protection statutes, and consumer fraud on behalf of purchasers and lessees of any model year 2016 to 2020 vehicle equipped with FCA’s 9-speed automatic transmission (the “Class Vehicles”), which were designed, manufactured, and distributed by defendant FCA US LLC.

The case is captioned Milisits, et al. v. FCA US LLC, No. 4:20-cv-11578 (E.D. Mich.). The Class Vehicles are the 2016-2020 Jeep Cherokee, 2016-2020 Jeep Renegade, 2016-2017 Chrysler 200,   2016-2020 Promaster City, 2017-2020 Jeep Compass, 2017-2020 Chrysler Pacifica, and 2016-2020 Fiat 500X.   

Plaintiffs allege that the 9-speed automatic transmission contains a defect that causes the Class Vehicles to exhibit rough, delayed, or sudden shifting or failure to shift; grinding or other loud noises during shifting; harsh engagement of gears; sudden or harsh accelerations/decelerations; sudden loss of power; premature transmission wear; and eventual transmission failure. The harsh shifting and driving conditions make it difficult for a driver to safely change lanes, make turns, merge into traffic, accelerate from stop light/sign, and accelerate onto highways/freeways. 

In July 2021, the Honorable Matthew F. Leitman denied the majority of FCA’s motion to dismiss, allowing Plaintiffs’ claims for violations of consumer protection statutes, negligent misrepresentation, fraud, and breaches of express warranties to move forward for the nationwide class and eleven state subclasses. The Court also allowed Plaintiffs’ breach of implied warranty claims for ten of the eleven state subclasses to move forward. The litigation is ongoing.
