On November 20, 2020, the Honorable Joel Schneider of the United States District Court for the District of New Jersey appointed shareholder Russell D. Paul as co-lead interim counsel in this proposed class action against defendants Subaru of America and Subaru Corporation. The case is captioned Weston, et al. v. Subaru of America, Inc., No. 1:20-cv-05876 (D.N.J.).

Plaintiffs, on behalf of purchasers and lessees of 2012-2020 Subaru Forester vehicles, 2015-2020 Subaru Legacy vehicles, and 2015-2020 Subaru Outback vehicles (the “Class Vehicles”), allege that the Class Vehicles contain one or more defects that cause sudden and unintended acceleration without driver input. This alarming defect causes the vehicles to accelerate without warning, often while the driver depresses the brake pedal and poses an extreme and unreasonable safety hazard to drivers, passengers, and pedestrians.

In May 2022, defendant Subaru of America answered plaintiffs’ complaint without moving to dismiss, and the Court largely denied defendant Subaru Corporation’s motion to dismiss, sustaining the majority of plaintiffs’ claims for breaches of warranty, violations of consumer protection statutes, and consumer fraud on behalf of nationwide and six state subclasses. The litigation is ongoing.
