(“CCI”) on behalf of approximately 296 individuals employed in the United States as Technicians during the time period at issue. Led by Shanon J. Carson and Camille Fundora Rodriguez of Berger Montague, the plaintiffs brought this unpaid overtime case alleging violations of the federal Fair Labor Standards Act, 29 U.S.C. § 201, et seq., and North Carolina Labor Laws. The case was litigated in the United States District Court for the Eastern District of North Carolina Western Division and was captioned Beasley, et al. v. Custom Communications, Inc., No. 5:15-CV-00583-F (E.D.N.C).
The plaintiffs were non-exempt, piece-rate paid Technicians who were employed by CCI on projects throughout the country, where they provided installation and repair services for satellite television and internet products, such as Dish Network. Plaintiffs routinely worked well over forty (40) hours per workweek, throughout the duration of their assignments, and were paid only a piece rate, with no overtime pay for hours worked in excess of forty. Plaintiffs primarily claimed that they were improperly classified as independent contractors by CCI and were not paid an overtime rate when they worked more than forty (40) hours per week. The settlement resolved the claims alleged in the action.
